Item 2
An Ordinance “TO FURTHER AMEND THE ZONING DISTRICT MAP OF THE CITY OF BIRMINGHAM” (Case No. ZAC2019–00007) to change zone district boundaries from QB-2, Qualified General Business District to QB-2, Qualified General Business District and thereby amending the “Q” conditions of Case ZAC2005–00113 (Ordinance #1814- G) to allow parking for the construction of a new church, filed by Perry Macon, representing the owners, First Baptist Church Woodlawn for the properties located at 106, 150 and 200 53rd Street North and 5230 1st Avenue North, Birmingham Alabama 35212, situated in the SW ¼ of Section 21, Township 17-S; 2-W, and the hearing of all interested parties.
The City Council voted to approve a request to amend the “Q” conditions (ZAC2005–00113, Ordinance #1814-G) to allow the construction of a new church in Woodlawn.
The City’s Long Range Land Use Plan identifies the property for General Commercial District; therefore, the proposed amendment of “Q” conditions is consistent with the Plan.
The Planning and Zoning Committee met at a Special Called Meeting on April 24th, 2019 and voted to Recommend approval of the applicant’s request with the following “Q” conditions, which is what the Council approved at today’s meeting:
- A minimum 5’ to a maximum 8’ privacy fence shall be constructed along the northern boundary and western boundary of the site in permitted area adjacent to residences to provide as a buffer from potential nuisance impacts.
- Submission to and approval by the planning staff of the Planning, Engineering, and Permits Department of a site development plan to include, but not limited to, the location and heights of all structures; parking; ingress and egress landscaping; location, size and number of all signs, storm water drainage; buffering and screening of solid waste disposal container constructed of wood, masonry brick, or concrete which is architecturally compatible with the primary building sufficient in height on all 4 sides with a boule wooded gate at the entrance; and screening of all HVAC units and satellite dishes. All on and off site improvements shall be developed and maintained in strict conformance with the approved site development plan. All landscaping as per approved landscaping plan, shall be installed prior to the occupancy of the development and shall be maintained in a living condition no less than as installed. Any amendments, additions, deletions, alteration or changes to any of the above listed standards of the approved site development plan, shall require approval of an amendment of the approval site development plan by the planning staff of the PEP Department
- Providing a minimum of 3 handicapped parking spaces on the site.
Item 18
A Resolution authorizing the Mayor to execute a Master Contract for Lighting Services NESC® Lease Agreement (Governmental) with Alabama Power Company (“APC”), for lease of equipment and electric service to operate the equipment and other APC activities. The City will transfer ownership of approximately two hundred sixty-six (266) light poles in sixteen (16) City parks and APC will convert them to Light Emitting Diode (“LED”) and make any necessary repairs/replacements.
The City Council passed a lease agreement with Alabama Power that will transfer ownership of 345 light fixtures in 16 city parks to the company to upgrade and maintain. Alabama Power will be converting these lights to Light Emitting Diode (LED) lights.
Not only will the new lights be more energy efficient, but they will provide a much needed light source for areas in Birmingham’s parks that have been left in the dark for some time. After requests from several Councilors, four additional parks were added so that each district would have a park slated for improved lighting.

Item 40
A Resolution appointing one (1) Full-time Municipal Judge for a term expiring January 21, 2023 and four (4) Special Municipal Judges, two for a term expiring January 3, 2021 and two for a term expiring February 7, 2021
The City Council voted to appoint Jameria Moore, who’ll be replacing Judge Cathy Daniel, and voted to re-appoint Judges Anita Westbury, Kechia Davis, and Lee Loder as Special (Part Time) Judges for terms ending June 11th, 2021.
Full Time Judge, Nyya Hudson’s 4-year term expires in October.
Toward the end of today’s meeting, the Council also voted to approve a Resolution supporting the creation of an additional Special Judge position in Municipal Court.
The Birmingham Municipal Court is authorized to hear misdemeanor criminal and traffic cases which involve offenses committed within its police jurisdiction. The Court operates in accordance with the Alabama State Code Title 12 Chapter 14 and the Birmingham General City Code Chapter 8.
The Municipal Court is required by law to perform the following:
- Issue arrest and search warrants
- Set bail and approve bonds
- Conduct trials and hearings
- Operate the Citations Bureau to process less serious traffic and some non-traffic cases without a formal court appearance
Birmingham Municipal Court is the vehicle through which most citizens come into contact with the judicial system, either as a defendant, complaining party, witness or victim.
