Item 7

A public show cause hearing to consider revoking the business licenses issued to Eastlake Suppertter, Inc., aka Eastlake Supertter, Inc., 421 Oporto Madrid Boulevard North, Birmingham, AL 35206, and to consider rescinding Resolution №1451–16, granting approval for an Off Premise Beer and Wine License to be used at 421 Oporto Madrid Boulevard North Suite A, approved on August 9, 2016, and Resolution №1453–16, granting approval for a Lounge Retail Liquor — Class II License to be used at 421 Oporto Madrid Boulevard North Suite B, approved on August 9, 2016.

After a public hearing, the Birmingham City Council voted to revoke the business license of the East Lake Supertter, better known as the East Lake Super Deli. The public hearing was prompted by a fatal shooting that occured in the gas station on the afternoon of Nov. 3, 2017 after a verbal altercation escalated. The security camera footage shows a man arguing with the cashier. The man can be heard saying, “I’ll kill you,” before being doused with pepper spray by the clerk.

The City Council cited the following section of the City’s Code of Ordinances

Sec. 3A-1–131. — Revocation of license for violations of the law.

Any lawful license issued to any person, firm or corporation to conduct any business shall be subject to revocation by the council of the city for the violation by the licensee, his or her agent, servant, or employee, of any provision of this chapter or of any ordinance of the city, or any statute of the state, relating to the business for which such license is issued; and shall also be subject to revocation by the city council if the licensee, his or her agent, servant, or employee under color of such license violates or aids or abets in violating or knowingly permits or suffers to be violated any penal ordinance of the city or any criminal law of the state; and shall also be subject to revocation by the council of the city if, in connection with the issuance or renewal of any license, the licensee or his or her agent filed or caused to be filed any application, affidavit, statement or other misleading statement or omission of a material fact; and shall also be subject to revocation if the licensee, his or her agent, servant, or employee is found to be operating the business for which such license is issued in such a manner as to be detrimental to the public health, safety or welfare or so as to constitute a nuisance.

The City Council deemed the business to be a public nuisance, and therefore voted to revoke their business license.

Item 16

A Resolution authorizing the Mayor to execute a Funding Agreement and a Project Cooperation Agreement with the Birmingham-Jefferson Civic Center Authority (“BJCC”), under which the BJCC will undertake a major expansion of its facilities through (i) the renovation of Legacy Arena and existing convention and meeting space, and (ii) construction of an open-air stadium and the City will financially support these efforts in the amount of $3,000,000.00 a year for a period of 30 years by pledging occupational taxes for this purpose.

In January, the Jefferson County Commission approved $30 million in funding; the largest contribution will be coming from the BJCC, who will pay $10.7 million in annual debt service for 30 years. The University of Alabama at Birmingham will lease the stadium to the tune of $4 million annually for their football games. Additional funding will come from corporate sponsors as well.

According to an independent feasibility study commission by the BJCC, the stadium, which is estimated to cost $174 million, could be completed as early as 2020 and generate roughly $5.5 million per year in tax revenue during the construction phase and as much as $9.9 million a year after construction.

100% of the sales tax revenues in the BJCC footprint attributable to the expansion will go into a dedicated neighborhood revitalization fund.

It is projected that 32 new full-time positions will be added to manage the new facility and that indirectly there could be upwards of 147 new jobs added within the community as a result.

Item 24

A Resolution appointing two (2) members to the Birmingham Jefferson County Transit Authority to fill the unexpired terms of Myeisha Hutchinson and O. Tameka Wren, both resigned, said terms expiring August 10, 2021.

The Birmingham City Council appointed Darryl Cunningham and Ledon Jones to the Birmingham Jefferson County Transit Authority (BJCTA) Board. The BJCTA Board consists of 9 members: 5 Birmingham Residents (appointed by the Birmingham City Council), 1 appointee from the City of Hoover, 1 appointee from the City of Bessemer, 1 appointee from the Jefferson County Commission, and 1 appointee from the City of Vestavia Hills.
