Item 1
An Ordinance “TO FURTHER AMEND THE ZONING DISTRICT MAP OF THE CITY OF BIRMINGHAM” (Case No. ZAC2019–00004) to change zone district boundaries from M-2, Heavy Industrial District to MU-D, Mixed-Use Downtown District, filed by Tim Larson, representing the owners, Birmingham POD, LLC for the property located at 1100 2nd Avenue South and situated in the NE¼ of Section 02, Township 18-S, Range 3-West, and the hearing of all interested parties.
The applicant is proposing creating a mixed use development with business, amphitheater retail and apartment type uses.
The City’s Long Range Land Use Plan identifies the property as Light Manufacturing. Although the proposed rezoning request is Not Consistent with the Long Range Land Use, the rezoning request is compatible with adjacent uses.
The Five Points South Neighborhood Association met at its regularly scheduled meeting on March 25, 2019 to review the proposed project and voted “To Recommend Approval” of the proposed rezoning request. The vote was 11 approved and 0 denied.
Zoning Advisory Committee Action:
The Zoning Advisory Committee met at its regularly scheduled meeting on April 2, 2019 and voted to recommend the rezoning request.
The City Council’s Planning & Zoning Committee met on April 4th, and moved the rezoning request to the full Council with a favorable recommendation.
Items 36–39
A Resolution authorizing the Director of Planning, Engineering and Permits to issue a condemnation repair permit to Wilbert Wilson, the owner or agent of the property located at 210 Graymont Avenue North, Birmingham, which was condemned by the Council April 23, 2002, in order to remove the weeds and trash from the premises within ten (10) days of permit issuance and to commence and make substantial repairs within 30 days of permit issuance, four (4) permits having been voided due to the lack of substantial repairs.
The owner of this property also had properties located at 214 Graymont Avenue North, 204 Graymont Avenue North, and 119–9th Avenue West previously condemned by the City due to their blighted condition. At the time of the initial permit issuance, the policy of the City Council’s Public Improvements and Beautification Committee was to trigger the City’s demolition process after an applicant failed to fix their property after 4 issued repair permits. Since then, the Committee’s policy has been changed to 2 permits without significant repairs triggering the City to demolish the property.
The Council voted unanimously to NOT approve these four repair permits, and the City will now begin the process to demolish the properties, as well as placing a tax lien on the properties. If the owner should attempt to sell any or all of those properties, he would have to pay the lien(s) first.
When applicants do get their repair permits approved, they have a time frame of 6 months per permit, with inspections happening every 30 days, instead of the previous policy of inspections every 90 days.

Item 52
The Birmingham City Council approved a $714,000 bid to remove and replace the playing field at the historic stadium. “We are truly excited about this upgrade to Legion Field. Hopefully this will get started within the next week to 10 days,” Council President Pro Tem Parker said following Tuesday’s vote. “The turf has been there for about 12 years and it was due to be replaced…We’re working toward getting more games at Legion Field and this will definitely help us market the stadium to teams. Over the last year, Parker and other city officials have been actively recruiting additional college football games to Legion Field. “I think the new turf allows us to attract more opportunities. This definitely marks a big item off our checklist,” Parker said.
